Terms of Service

While we always attempt to perform the very best service for our customers, there are some rules we need to follow as well as expectations to set for our level of service.

Snow clearing services shall be provided for greater than 1 inch of new snow in a single snow event. We will perform one or more passes after city crews have completed their work, depending upon the duration and severity of the snowfall event. The timing of service visits will vary from storm to storm, according to the timing of the snowfall. Iceworks (hereinafter referred to as “Iceworks”) shall be permitted to remove snow from your property at any time of the day or night. Iceworks shall perform only one clearing for snowfalls under 2 inches, occurring after city crews have completed their work or once the snow has stopped falling if the city crews do not pass.

Snowblowing means blowing snow from the observable physical driveway surface to any permissible area nearby. If inadequate space exists on your property for snow storage — either at the onset of the season or as the season progresses — you agree to allow Iceworks to use space on either side of the driveway or to make alternate arrangements for snow storage with a neighbor. Unless otherwise specified, no loading or transporting snow, sanding, salting, de-icing, or hand shoveling is included as part of our service.

The term of this service is from November 1 to April 15 (holidays included) of the indicated season.

Iceworks pricing for snow removal services is subject to increase annually, depending upon increases in fuel prices, labor costs, and general maintenance as market factors change.

If vehicles block areas of the driveway in any form, Iceworks will only clear snow in areas accessible to our equipment opening onto the street. Iceworks will only return to clean up where the car was parked if a complete second pass is planned.

In the event that children are playing in the area where snow will be blown, service will not be provided until the storage area is free of activity.

Additional services requested by you that cannot be performed during regular snow removal hours may be performed at an additional charge (e.g., a request for individual cleaning when a vehicle is moved upon return from vacation; a request for the removal of snow shoveled from a roof or walkway after the snowblower has already passed; or a request for the removal of snow accumulations less than 1 inch on a non-snow day).

Removal of drifted snow is your responsibility.

1–2 driveway stakes and markers will be installed on your driveway at the beginning of every snow removal season.

Due to the risks posed by our equipment to immovable property, you accept that our drivers will stay around two (2) feet away from garage doors, door frames, and all other obstacles at all times. You are responsible for the removal of snow within this buffer area.

Iceworks shall exercise due diligence in the performance of its work to avoid property damage. To assist Iceworks in preventing damage, it is your responsibility to keep the snow removal area (i.e., driveway) free of all objects. In particular, Iceworks shall not be held responsible for damages, including but not limited to the following:

  • Portable basketball nets, plant pots, toys, hockey sticks, extension cords, Christmas tree lights, etc. All moveable property must either be removed completely (preferable) or placed no less than four (4) feet from the edge of the driveway before each snow event.
  • Garbage cans and recycling bins. You are responsible for moving garbage and recycling containers off the driveway on a snow day. Iceworks will work around any receptacles it encounters but will not move them or clear the snow underneath or in areas where the bins prevent access from the street.
  • Immoveable basketball nets. The net must be turned away from the driveway before the commencement of the winter season.
  • Downspouts and extensions. These must be unscrewed and removed entirely before the commencement of the winter season.
  • Elevated water valve caps. Protruding water valve caps must be hammered down or relocated to the level of the surrounding asphalt before the commencement of the winter season.
  • Fixed masonry and/or wooden structures. You are responsible for notifying Iceworks of structures that protrude into the driveway and for placing additional markers for protection. Iceworks will not be liable for damage to immovable objects hidden under snow and/or unidentified by protective markers.
  • Heaved, chipped, or uneven asphalt/interlock. Deteriorated driveways are more likely to be scratched or chipped during snow removal operations. Iceworks will not be responsible for replacing pieces of asphalt, concrete, or interlock caught and torn out by snow-blowing equipment dragged across uneven or deteriorated surfaces.
  • Trees, shrubs, and hedges. You are responsible for winterizing and protecting all trees, shrubs, or hedges near your driveway and for knocking accumulated snow off branches. Iceworks shall not be liable for broken branches or shrubs/hedges damaged by heavy snow accumulation or snow removal operations.

Branches on trees shall be trimmed by yourself to a clearance of at least 10 feet to prevent damage to Iceworks equipment and to grant maximum accessibility to the driveway.

Homeowners with gravel driveways or small decorative rocks adjacent to or near the driveway will be responsible for raking any stones off their lawns in the spring that get deposited there during snow removal operations in the winter.

Iceworks shall be responsible for and shall restore at its expense all damage to your property caused by Iceworks in the performance of this service, apart from damage reasonably foreseeable as a consequence of snow removal. Iceworks shall not be responsible for scrapes, scratches, rust marks, and other surface damage on driveway surfaces, curbs, and adjacent structures and surfaces resulting from snow removal operations.

Applicable damages must be reported by you to the Iceworks office within 72 hours of their occurrence. Otherwise, a thorough investigation will be conducted by Iceworks to verify the validity of your damage claim.

Iceworks shall indemnify and hold harmless you, your agents, and employees from and against any claim for damages arising from an occurrence of bodily injury, death, or the destruction of tangible personal property, provided that the damages were caused by the negligence or breach of this service by Iceworks or anyone for whom Iceworks is responsible in law, and provided that Iceworks is given notice of the claim within a reasonable time following the occurrence but in any event within 72 hours of you first acquiring knowledge of the circumstances of the claim. You expressly waive the right to be indemnified by Iceworks and agree to indemnify and hold harmless Iceworks, its agents, and employees from and against any claim for damages save and except those which arise due to the negligence or breach of this service by Iceworks as described in this paragraph.

You expressly acknowledge that you have physical possession of, are responsible for, and have control over the condition of the premises. You further acknowledge that Iceworks has no duty to inspect or monitor the condition of the premises. During the entire term of this service it is your sole responsibility to engage a reasonable, practical, and effective system to monitor the weather in the vicinity of the premises, to perform any additional snow clearing required between attendances by Iceworks, and to determine when and in what quantities ice-melting products are to be applied. Iceworks will not be responsible for any damages or claims whatsoever relating to or caused in whole or in part by the failure to provide ice-melting products to the premises, and you will indemnify and save Iceworks and its agents and employees harmless from and against any such claims.

Checks returned for any reason will incur an administrative fee of $35.00 per check.

In default of any payment or upon the breach of any of the conditions herein on your part, this service agreement shall be rendered null and void. Iceworks shall be released from all liability for services to that time and shall not be required to perform any further services under this agreement. If Iceworks is proven to be in breach of any of the conditions herein, this service agreement shall be canceled as of the date of notification, and you will be reimbursed for any amounts prepaid from that date for the balance of the service period. In the event of the sale or re-occupation of your home, this contract will not be canceled or refunded but may be transferred into the name of the new homeowners.

Transmission of accounts-receivable documents (e.g., renewal notices, receipts, demand letters), legal notices, service notifications (e.g., service logs, obstacle reports, damage reports), general correspondence (e.g., thank-you notes, customer-service response letters, newsletters), and any other documents relevant to services provided by Iceworks shall be conducted by email where possible. By providing your email address orally or in writing while doing business with Iceworks, or afterward, you provide express consent to receive the documents, notices, and correspondence mentioned above by email from Iceworks.

Referral rewards

If you're a current Iceworks customer and someone new signs up and pays for a season using your referral link, you each receive the same amount: $25, or $50 each when the two addresses are on the same street. Same street means the street name and postcode on both addresses match; we read past differences in spelling and abbreviation, and you don't have to tell us. Their share comes off the price of their first season. Yours is a reward, earned when their payment clears rather than when they click your link.

We normally send the reward back to the card you paid us with, about ten days after their order clears. If we don't have a card of yours to send it to, it becomes a credit on your account and comes off the price of your next Iceworks season. Credits have no cash value, can't be transferred, and can't be applied to anything other than an Iceworks seasonal driveway service. A credit can cover the whole price of a season; anything left over carries to the following season. Credits are never paid out in cash.

One level only. You earn a reward for people you refer. You don't earn anything from people they go on to refer.

Rewards are earned on referrals that pay by November 30 of the season they were referred for. Unused credits expire on April 15 two seasons later. If we change the amounts or end the program, rewards you've already earned stay yours until they expire, and the change applies only to referrals made afterwards.

This is for new customers only. We don't pay a reward, and there's no discount, where the household has ever bought a season from us, where they share an address, email address or phone number with you, or where the address is outside our routes. A customer renewing for another year is a renewal, not a referral. If a referred order is refunded before we've paid you, the reward goes with it. If it's refunded afterwards, we leave it alone. We may void a reward obtained by misrepresentation.
